The FTC just did something that Washington almost never does with AI: get specific.
The AI Policy Statement, published March 11, 2026, interprets Section 5 of the FTC Act — the century-old ban on unfair or deceptive practices — as applying directly to AI systems across their entire lifecycle. Including the AI agents running your workflows right now.
This isn’t a new law. It’s worse — it’s an enforcement interpretation of an existing one. Which means the FTC doesn’t need Congress to act. They can start enforcing immediately.
Five Domains, One Message: We’re Watching
The statement carves out five regulatory focus areas:

Why Agent Builders Should Pay Attention
Here’s the uncomfortable reality: most AI agents make automated decisions affecting users. An OpenClaw agent that manages your calendar is making decisions about your time.
