The agreement between you and OpenClaw AI.

1. Acceptance of Terms
By accessing or using OpenClaw AI's services, website (openclawai.io), managed hosting, iOS application, or any related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Services.
If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Service Description
OpenClaw AI provides an open-source AI assistant platform that enables users to create, customize, and deploy AI-powered bots across multiple messaging platforms. Our Services include:
- Open-Source Software: The OpenClaw core platform, available for free self-hosting under the MIT License.
- Managed Hosting: A cloud-hosted version of OpenClaw where we handle infrastructure, maintenance, and updates.
- iOS Application: A mobile app for managing and interacting with your OpenClaw bots.
- ClawHub Skills Marketplace: A library of pre-built skills and integrations.
- Website & Documentation: Resources, guides, and support materials at openclawai.io.
3. Account Responsibilities
When you create an account with OpenClaw, you agree to:
- Provide accurate, current, and complete information
- Maintain the security of your account credentials
- Promptly notify us of any unauthorized access or security breach
- Accept responsibility for all activities that occur under your account
- Not share your account with others or create multiple accounts for abusive purposes
You must be at least 13 years old (or 16 in the EU) to create an account.
4. Acceptable Use Policy
You agree not to use the Services to:
- Violate any applicable laws or regulations
- Generate, store, or distribute illegal content
- Harass, abuse, threaten, or harm others
- Impersonate any person or entity
- Distribute malware, spam, or phishing content
- Attempt to gain unauthorized access to our systems or other users' accounts
- Interfere with or disrupt the integrity or performance of the Services
- Use the Services for any purpose that is harmful, fraudulent, or deceptive
- Circumvent rate limits, access controls, or other technical restrictions
We reserve the right to suspend or terminate accounts that violate this policy, with or without notice, depending on the severity of the violation.
5. Intellectual Property
Your Data
You retain all rights to your data, including conversations, configurations, custom skills, and any content you create using the Services. We do not claim ownership of your content.
Our Platform
OpenClaw AI owns and retains all rights to the Services' branding, trademarks, website design, managed hosting infrastructure, and any proprietary components not covered by the open-source license. The OpenClaw name, logo, and brand identity are trademarks of OpenClaw AI.
AI-Generated Content
Content generated by AI through the Services is subject to the terms of your AI provider. OpenClaw does not claim ownership of AI-generated responses.
6. Open-Source License
The OpenClaw core platform is released under the MIT License. This means you are free to:
- Use the software for any purpose
- Modify and distribute the software
- Use it commercially
- Include it in proprietary projects
The MIT License applies only to the open-source codebase. Our managed hosting service, proprietary add-ons, and brand assets are governed by these Terms.
7. Managed Hosting & SLA
For managed hosting customers:
- Uptime Target: We target 99.9% uptime for our managed hosting infrastructure, measured monthly.
- Scheduled Maintenance: We will provide at least 24 hours notice for planned maintenance. Emergency maintenance may occur without notice.
- Data Isolation: Each customer's instance is isolated. Your data is not shared with or accessible to other customers.
- Backups: We perform regular automated backups. You are also encouraged to export and back up your own data.
- Support: Paid plans include priority support with reasonable response times during business hours.
If we fail to meet our uptime target in a given month, affected customers may request a pro-rated service credit. This is your sole remedy for downtime.
8. Payment Terms
- Pricing: The Premium managed hosting plan is $29.99/month. Prices are in USD unless otherwise stated.
- Billing Cycle: Subscriptions are billed monthly. Your billing cycle begins on the date of your first payment.
- Free Tier: The free tier is provided as-is, with no guaranteed service levels.
- Payment Method: Payments are processed via Stripe. You agree to provide a valid payment method and keep it current.
- Refunds: We offer a 14-day money-back guarantee for new subscribers. After that period, payments are non-refundable.
- Price Changes: We will provide at least 30 days' notice before any price increases. Existing subscribers will be notified via email.
- Taxes: Prices do not include applicable taxes. You are responsible for any taxes associated with your subscription.
9. Limitation of Liability
To the maximum extent permitted by applicable law:
- OpenClaw AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill.
- Our total liability for any claim arising from these Terms or the Services shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
- For free tier users, our total liability shall not exceed $50 USD.
These limitations apply regardless of the theory of liability (contract, tort, strict liability, or otherwise).
10. Disclaimer of Warranties
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
- The Services will be uninterrupted, error-free, or secure
- AI-generated content will be accurate, complete, or appropriate
- The Services will meet your specific requirements
- Any defects will be corrected in a specific timeframe
11. Termination
By You
You may terminate your account at any time by contacting us or using the account settings. Upon termination:
- Your access to managed hosting will be revoked
- You may export your data before termination
- We will delete your data within 30 days of your request
By Us
We may suspend or terminate your account if:
- You violate these Terms or the Acceptable Use Policy
- Your account is used for illegal activities
- You fail to pay applicable fees after notice
- Continued provision of the service is impractical or illegal
We will provide reasonable notice before termination unless the violation poses an immediate risk.
Effect of Termination
Sections regarding Intellectual Property, Limitation of Liability, Disclaimer of Warranties, and Governing Law survive termination.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
Any disputes arising from these Terms or the Services shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
13. Changes to These Terms
We may modify these Terms at any time. We will provide at least 30 days' notice of material changes by posting the updated Terms on this page and updating the "Last updated" date. For significant changes, we will also notify registered users via email.
Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
