Here’s the uncomfortable truth about AI regulation in 2026: the laws already on the books don’t cover the technology that’s actually shipping.

At two separate panel discussions at Nvidia’s GTC developer conference last week, legal experts from Simmons & Simmons, Nvidia, and the California Chamber of Commerce laid out the gap — and it’s wider than most enterprise leaders realize.

What Current Laws Actually Cover (and Don’t)

Existing AI regulations — the EU AI Act, California’s transparency laws, and scattered state-level rules — were written for a world of LLMs and deepfakes. They target frontier models, high-risk systems, and human-facing content generation.

What they don’t cover:

  • Agentic AI systems that take autonomous actions
  • Self-updating models that evolve by interacting with other agents or ingesting company documents
  • System-to-system interactions where no human is in the loop
  • World models powering smart robots and embodied AI

“Some obligations, like human oversight, are going to be really challenging when it comes to things like AI agents,” said William Dunning, managing associate for AI regulation at Simmons & Simmons.

Current laws assume system-to-human interactions — they require transparency so people know when AI is involved. But when Agent A calls Agent B calls Agent C to execute a workflow? The regulatory framework has nothing to say about it.

The EU AI Act: Already Delayed

The EU AI Act was supposed to be the gold standard. Passed in 2024, it requires deepfake labeling and regulates high-risk AI content.

On March 26, 2026, the European Parliament voted to delay parts of the Act’s implementation — though the delay still needs Council approval. The Act will eventually be enforced this year, but significant ambiguity remains around what exactly will be enforced.

Meanwhile, the US has no federal AI regulation in sight. States are going their own way: California focuses on transparency and watermarking. NIST is working on trustworthiness and safety standards. And product liability lawsuits are filling the vacuum.

“If it isn’t safe, it’s going to cause harm, and existing frameworks like product liability will kick in to compensate victims and to deter companies from causing that harm,” said Minesh Tanna, partner and global AI lead at Simmons & Simmons.

The 12-Month Shift: From Policymaking to Enforcement

According to Nikki Pope, senior director for AI and legal ethics at Nvidia, the biggest change coming in the next year is a pivot from writing rules to enforcing them.

That means organizations running AI agents today are operating in a window where:

  1. The tech is live — agents are in production across enterprise workflows
  2. The rules are vague — current laws weren’t written for this tech
  3. Enforcement is coming — within 12 months, regulators shift to action
  4. Liability already exists — product liability lawsuits don’t wait for new legislation

  • Least-privilege access for every agent and MCP server
  • Audit trails for agent actions and credential usage
  • Human-in-the-loop for high-impact decisions
  • Behavioral monitoring for drift detection

4. Prepare for Product Liability

If your agent causes harm — deletes data, leaks credentials, makes unauthorized purchases, sends wrong information — existing product liability frameworks apply. You don’t need a new law to be sued.

The Airplane Analogy

Tanna compared the goal of AI regulation to airplane travel: people should feel safe using AI the way passengers feel when they board a plane. That requires standardized safety measures, independent oversight, and a track record of reliability.

We’re not there yet. But the trajectory is clear: governance now, enforcement soon, liability always.

The Bottom Line

AI agent regulations will eventually catch up to the technology. When they do, they’ll likely cover:

  • Agent autonomy levels and required human oversight
  • Bias in AI-driven hiring and decision-making
  • AI vs. human content attribution
  • Agent-to-agent interaction transparency
  • Self-updating model governance

Organizations that build governance frameworks now — even rough ones — will be months ahead of those who wait for the rules to be written.
